Understanding the Refugee Process and Timeline in Canada: What You Need to Know

Seeking refuge in a new country is often a life-altering decision, filled with uncertainty and the hope of a safer, brighter future. In Canada, refugees are welcomed with the opportunity to apply for protection, but the process can be complex and challenging to navigate. Understanding the steps involved and the expected timeline can help you prepare for what's ahead.

At Fouad Legal, we are dedicated to guiding individuals and families through the refugee process with expertise, compassion, and unwavering support. In this post, we will outline the key steps involved in the refugee process and provide a general timeline so you can understand what to expect.

Step 1: Refugee Claim Submission

The first step in the refugee process is submitting a refugee claim. This can be done in two main ways:

  • At a Port of Entry: If you arrive in Canada and are seeking protection, you can make a claim at the border (land, air, or sea port). Upon arrival, you will meet with a Canada Border Services Agency (CBSA) officer, who will assess your eligibility to make a claim.

  • From Inside Canada: If you are already in Canada, you can submit your claim to the Immigration and Refugee Board (IRB) by filling out the required forms and providing supporting documents.

Step 2: Eligibility Determination

After your claim is submitted, the Immigration and Refugee Board (IRB) will determine whether you are eligible to make a refugee claim. This involves a review of the information you provided, including your personal background, the country you are fleeing from, and the reasons you are seeking protection.

  • Eligible Claimants: If you are found eligible, your claim will move forward to the next stage, which involves a hearing where you will present your case before the Refugee Protection Division (RPD).

  • Ineligible Claimants: If your claim is deemed ineligible, you will be informed of the decision. You may have the option to appeal or seek judicial review, depending on your situation.

Step 3: Refugee Protection Division (RPD) Hearing

If your claim is eligible, you will be scheduled for a hearing with the Refugee Protection Division (RPD) of the Immigration and Refugee Board. During this hearing, you will have the opportunity to explain why you need protection in Canada. You will need to provide evidence of the threats or dangers you face in your home country, such as documentation, witness statements, or expert opinions.

The RPD member will review the evidence presented and ask questions to understand your situation better. It is important to be honest, clear, and thorough in your responses. Having legal representation during the hearing can significantly increase your chances of success, as a lawyer can help you prepare and present your case effectively.

Step 4: Decision from the RPD

After your hearing, the RPD will issue a decision on your refugee claim. This decision can take several weeks to months to be made, depending on the volume of cases and the complexity of your situation.

  • Positive Decision: If the RPD grants you refugee status, you will be recognized as a Convention Refugee or a person in need of protection. This allows you to stay in Canada and begin the process of applying for permanent residency.

  • Negative Decision: If your claim is denied, you may have the option to appeal the decision to the Refugee Appeal Division (RAD) or seek judicial review through the Federal Court. You must act quickly if you wish to appeal, as there are strict deadlines for submitting appeals.

Step 5: Refugee Appeal Division (RAD) Appeal

If your claim is denied and you decide to appeal, your case will be heard by the Refugee Appeal Division (RAD). The RAD will review the decision made by the RPD and any new evidence you provide. They may uphold the RPD’s decision, overturn it, or send it back for further review.

It is important to present new or additional evidence that was not available during the RPD hearing. Having legal counsel is crucial at this stage to ensure you are adequately represented and your case is well-prepared.

Step 6: Permanent Residency Application

If your refugee claim is successful and you are granted refugee status, you can apply for permanent residency in Canada. The application process involves submitting an application package, undergoing medical exams and background checks, and waiting for a decision from Immigration, Refugees and Citizenship Canada (IRCC).

Once you are approved for permanent residency, you will be issued a permanent resident card, allowing you to live and work freely in Canada.

Timeline of the Refugee Process

The timeline for a refugee claim can vary depending on several factors, including the complexity of the case, the volume of applications, and the country from which you are fleeing. Below is a general timeline:

  • Claim Submission to Eligibility Determination: This can take a few weeks to a couple of months, depending on your circumstances.

  • Refugee Hearing: Typically scheduled within 2 to 6 months after your claim is determined to be eligible. In some cases, hearings can be delayed, especially during high-demand periods.

  • RPD Decision: You can expect to receive a decision within a few weeks to several months after your hearing.

  • Appeal Process (if applicable): If you appeal to the RAD, the process may take an additional 6 to 12 months, depending on the case.

  • Permanent Residency: If your refugee claim is approved, you can apply for permanent residency. This process can take several months to a year, depending on the volume of applications and the complexity of your case.
